Terms and Conditions
1. Introduction
1.1 Teach Me Islam (TMI). We provide the best quality of Islamic education, all online delivered by highly qualified and British-educated Islamic tutors in the comfort of your home. We intend to be an innovative platform for Islamic education being delivered in modern holistic ways and aspire to educate millions of students on a global scale.
1.2 TMI allows Students to find qualified Islamic Tutors most suitable to them. Book a private one-to-one tuition session or online classes and pay for bookings all online. By using the TMI platform, app and website you confirm to adhere to all of our Terms and Conditions.
1.3 These Terms and the Contract are set out in the English language only.
1.4 TeachMeIslamApp.com Ltd (company number 11414483) is a company registered in England and Wales and our registered office is at Co Ukmal Unit 7, 3-5 Little Somerset Street, London, England, E1 8AH.
1.5 TMI connects highly qualified, experienced and Enhanced DBS-checked Islamic tutors with parents/students who require high-quality online Islamic Education for their children and themselves.
1.6 All tutors are experienced in teaching and working with children and adults alongside their own professional careers/jobs. All tutors share the same passion and ethos of Islamic teachings which underlines their approach to teaching. Sessions are conducted in highly professional, interactive and engaging methods.
1.7 TMI acts as an agent for the introduction of one or more tutors to our clients, customers, and their parents as appropriate. The TMI app itself does not provide tutoring services. TMI is a tutoring agency, and we are a party to this contract.
1.8 Students are referred to in this contract as the Client, Customer or Student, and you are the other party to this contract. You agree to the purchase of tutoring services on behalf of the student. The student may be yourself or another person. The student is the person who receives the tutoring service through sessions of tutoring with our tutors.
1.9 Each Client agrees to these terms and conditions which relate to TMI’s introduction of a tutor to you to undertake the Islamic education courses prepared by TMI.
1.10 Each Client acknowledges that these terms govern the legal rights and obligations between the Client and TMI. TMI reserves the right to alter these terms and conditions. Further, no variation or alteration of these terms by the Client shall be valid unless expressly approved in writing by TMI.
2. The tuition courses
2.1 The curriculum is simple, comprehensive, consistent, and relevant to Muslims who are being brought up in a modern, fast-changing world and who want to study to understand Islam in a loving and forward-thinking 21st Century context. With fixed unison course books are also selected with an interactive syllabus for children and adults of all ages. Allowing tutors to spend less time planning and more time focusing on the progress and catering teaching methods per student/class.
2.2 TMI programmes have been structured and planned to cover all the main topics in each programme, allowing the students to achieve a great understanding and knowledge of Islam through modern, interactive, and enjoyable methods to best suit each individual’s learning needs. 2.3 TMI has compiled 3 simple, easy-to-progress, yet most popular programmes that are currently in demand within Islamic education amongst children and adults. Every individual student upon completing each programme will receive a certificate.
2.4 The TMI courses all have fixed programme materials for students that must be purchased by each student at the beginning of their programme separately. Our programme material is well-structured and based on interactive methods of learning guided by our consultants (tutors).
2.5 Please note the pricing is based on the 2 tuition options we have online, and the payment method selected for any of our 3 programmes paid in advance monthly, in instalments or in full.
2.6 By booking a Session with the Tutor, the Client agrees to be bound by these Terms and Conditions and by the Terms and Conditions which govern their relationship with the Tutor. The Tutor is self-employed and engaged by the Client to provide tuition to the student. Clients should be aware that the Tutor does not have the power to bind TMI in any way.
Online group lessons
2.7 TMI offers small group classes with up to 10 students in each group that are fixed as either one lesson a week or two lessons for a period of 1-hour in total. This class reserves your space for the programme if your payments are received and paid on time in advance depending on the payment option selected by our customers.
2.8 TMI online group lessons allow you to complete any of our programmes in 6,12- and 24-months giving students at least weekly lessons/classes.
2.9 The group lessons are structured to ensure that all students have the benefit of both learning methods of peer learning and the individual help and effectiveness of one-to-one support from the tutor.
2.10 Our group lessons are secured by the advanced payments before lessons ensuring your space is secured. Until the completion of your chosen programme to be awarded a certificate. All online lessons are delivered virtually via a platform called zoom.
2.11 All payments made for any one of our programmes are non-refundable once payment is made. Any student who wishes to cancel or stop online lessons is required to provide a full 1 months’ notice for us to cancel the subscription. Failure to provide this notice will result in no refunds being issued.
2.12 If you cancel your TMI subscription to online lessons, when we receive your written notice, we will send you an acknowledgement email to confirm the date that your TMI subscription to online lessons will end. If you do not receive this acknowledgement, you must assume that we have not received your cancellation notice and you must contact us and send a further cancellation notice to us at [email protected].
3. Tuition requirements
3.1 Each programme also has its programme material listed on our website that will need to be purchased before the first tuition session. TMI offers a discount on most of the programme material bundles exclusively to students who purchase through the TMI website. To make it as easy as possible for students TMI has put direct links to take you straight to check out via the TMI website www.teachmeislamapp.com.
3.2 For the convenience of customers and the structure of our programmes all learning materials are pre-selected and fixed for all programmes, with transparent prices and enable payments to be made in advance. For the ease of students and parents to purchase. Please note the cost of the course material is not included in the tuition fee.
3.3 Female and male tutors are available to choose from online one-to-one tuition sessions or group sessions.
3.4 Students have the option to opt-out of group lessons. We require a 1 month’s notice to be provided to change any booked group lessons to allow the TMI Team to find new students for the group classes.
4. Payments (for tutors)
4.1 All payments including online group session payments are processed via our website through a secure payment processor named Stripe.
4.2 Any refund requests that are emailed to [email protected] once reviewed and if it is according to our general refund/cancellations/missed lesson policy can take up to 10 working days to return to customer bank accounts. After Stripe charges their platform admission fee for the refund.
4.3 All other payment options that are processed for any one of our programmes are non-refundable once payment is made.
4.4 Tutors will be paid at the end of every month, invoices and timesheets are processed on the 1st of the following month and payments are made for all completed bookings directly to tutors’ bank account by the 7th of the new month.
4.5 All active tutors are paid at the beginning of the following month for their completed bookings and hours that were taught in the groups according to our general policy. Tutors are paid for the number of students who attend their class. Students who provide notice 7 days in advance to change the date of a one-to-one lesson, or due to extreme emergency reasons determined by TMI at its absolute discretion if a lesser period of notice is provided, can change the date of an arranged lesson within the same monthly period, however, the student will still be obliged to attend the rearranged lesson otherwise the student will continue to be charged for the lesson irrespective of whether they attend the lesson.
The reason for this is that our Tutors commit to providing lessons and lose the opportunity to provide lessons to other students if a student fails to attend a lesson. Please inform the TMI admin if your payment details change so we can update our payment records for you.
4.6 . Replacements and Termination
- If the Tutor is unable to complete the Course of Tuition, or the Client requests a replacement Tutor because they are not satisfied with the original Tutor assigned to them, TMI will endeavour to find up to two suitable replacement Tutors regarding the level and subject for which tuition is required.
- If TMI is unable to find such a suitable replacement Tutor within a reasonable time to complete the remaining Sessions of the Course of Tuition, TMI will refund a portion of the fees pre-paid by the Client representing the number of sessions that the Tutor or any replacement Tutor has been unable to complete.
- If the replacement Tutors meet TMI’s criteria for suitability for the job in terms of subject and level knowledge and is available at the same time or another time convenient for the Client, then TMI has fulfilled its obligations.
- If the Client wishes to terminate the Tuition mid-Course for any reason, no refunds can be granted for the balance of sessions that have been taught; furthermore, one month’s notice must be provided. In that month the Client may choose to utilise the Session or Sessions that were planned to occur during that month, or not, but will not be refunded if the Client chooses not to utilise the Session or Sessions during that month. TMI will refund all monies prepaid excluding fees for the sessions that have already been taught and those fees for the month following the notification of Termination.
- Should the Tutor not be available on the day, the Client will be informed, and a re-arranged time may be offered by the Tutor. If a suitable alternative time cannot immediately be arranged, TMI must be immediately informed, and this will be a credit Session that the tutor and client can arrange in the future.
- If a tutorial falls on a Bank Holiday or other national or religious holiday that either the Tutor or the Client wishes to observe, then an alternative Session must be arranged and TMI must be informed of any new arrangements.
- If the Student is late for a Session, the Tutor may choose to but is not obligated to work beyond the scheduled end time. If the Tutor stops work at the scheduled end time, the Session will be charged at the usual price. If the Tutor agrees to work beyond the scheduled end time at the Client’s request, the Tutor may choose to charge the Client for the additional time. If a Tutor is late for a Session, then it is the duty of the Tutor to arrange to make up the lost time.
- If the Student or Client chooses to terminate a Session early (for example, after half an hour of a one-hour session), the Session will be charged at the usual price
4.7 Payment (for students/parents)
- The Client will pay via our online payment system, Stripe. Upon making a payment students and parents will be sent a receipt or invoice via email for their transaction from Teach Me Islam Admin support via stripe on behalf of TEACH ME ISLAM APP LIMITED.
- The Client will pay on a monthly basis (4-week cycle) in advance. The Client will be invoiced during every 4-week cycle in respect of tuition that will be delivered in the course of the following (4 lessons) month.
- Tuition will not begin prior to receipt of payment for the month or period in question
4.8 Please, refer to clauses 10 and 11 for information on other cancellation terms.
4.9 If you have purchased your TMI lessons online, you have a legal right to change your mind within 14 days of making your initial purchase and receive a refund. If you choose to cancel within the cooling-off period, we will give you a full refund of any TMI fees you have paid. This legal right no longer remains available if the first lesson is utilised within these 14 days.
5. Fixed Fee and Discount Packages
5.1 Each tuition model must be paid in advance.
5.2 We have payment options for one-to-one lessons and online group classes online with further discounts displayed on our site throughout the year.
6. TMI Responsibilities
6.1 We provide a platform for Tutors to easily advertise their profiles including details on their qualifications, experience, DBS certificates and all the unique facilities of the TMI platform.
6.2 We will maintain a functioning booking site which will support a platform with individual profiles, communication systems and a booking platform.
6.3 We will communicate to our customers any planned maintenance of the app and Website or any downtime.
6.4 We will use reasonable endeavours to keep the Website free from viruses.
6.5 We will use reasonable endeavours to check the identity of all Tutors and carry out background checks on Tutors through references and Enhanced DBS checks.
6.6 We will decide when a Tutor’s profile is sufficiently complete to be set live on the TMI platform and be accessible to other Users once TMI has approved a tutor’s profile after the DBS and background checks via a direct interview.
6.7 We will maintain the option for communications of new Bookings, confirmation of Bookings and cancellations, to both Students and Tutors by email and phone call.
6.8 We will ensure that each Student’s payment of Lesson Fees and the payment of each Tutor’s Fees are processed promptly at the end of every month and would arrive by the 7th of the following month when there is no Complaint regarding the completed bookings or Failed Payment.
6.9 We will ensure that Complaints are dealt with promptly and by these terms and conditions.
6.10 For Any refund that is due, we will ensure that it is made promptly and by these terms and conditions.
6.11 We will take precautions we consider reasonable to protect Students’ and Tutors’ information under these terms and conditions.
6.12 We will monitor postings and bookings made on the TMI platform and messages sent between Students and Tutors. To effectively connect tutors’ and students’ sources to one another and to stop misuse of the facilities of the TMI platform.
6.13 We will review with Tutors and Students the quality, experience, and delivery of lessons to ensure our Operations and Customer Care are maintaining the best service possible.
7. Disclaimers and Limited Liabilities
7.1 Nothing in these terms and conditions in any way limits or excludes our liability for negligence causing death or personal injury, fraud, or fraudulent misrepresentation or for anything which is not permitted by law to be excluded or limited. Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982.
7.2 TMI does not accept any liability for any claims by the Client arising out of or related to the provision of tutoring services by the Tutor, nor will TMI be liable to the Client or any third party for any act, omission, or error (whether wilful, negligent or otherwise) of the Tutor. TMI is not responsible for insurance arrangements in respect of the Tutor providing tutoring services and the Client should note that this is the case.
7.3 All Users must give us a reasonable opportunity to remedy any matter for which we are potentially liable before incurring any costs remedying the matter themselves.
7.4 If you are a User, we shall not be liable for any loss or damage caused by us or tutors or agents in circumstances where: i. there is no breach of a legal duty of care owed to you by us or by any of the self-employed tutors or agents; ii. such loss or damage was not reasonably foreseeable by both parties; and iii. such loss or damage is caused by you, for example by not complying with these terms and conditions.
7.5 Subject to Clause 7.1, we will not be liable to you, whether in contract, tort (including negligence), for breach of statutory duty or otherwise, arising under or in connection with the Contract for i. loss of profits; ii. loss of sales or business; iii. loss of agreements or contracts; iv. loss of use or corruption of software, data or information; loss of or damage to goodwill; and any indirect or consequential loss.
7.6 If you are a User, you will be liable for any reasonably foreseeable loss or damage we suffer arising from your breach of these terms and conditions or misuse of our Website and App.
7.7 The following clauses apply only if you are not a consumer:
7.8 To the extent allowed by law, you and we exclude all terms, whether imposed by statute or by law or otherwise, that are not expressly stated in these terms and conditions. In this clause, any reference to us includes the self-employed tutors/consultants who use TMI.
7.9 Our liability of any kind (including our negligence) concerning our App for any one event or series of related events is limited to £100 or the total Platform Fees paid by you in the 12 months before the event(s) complained of whichever is higher.
7.10 In no event (including our negligence) will we be liable for any: i. economic losses (including, without limitation, loss of revenues, profits, contracts, business, or anticipated savings); ii. loss of goodwill or reputation; iii. special, indirect, or consequential losses; or iv. damage to or loss of data (even if we have been advised of the possibility of such losses).
7.11 You will indemnify us against all claims and liabilities directly or indirectly related to your use of the Website/App and/or breach of these terms and conditions.
7.12 These terms and conditions constitute the entire agreement between us with respect to their subject matter and supersede any previous communications or agreements between us. Both parties acknowledge that there have been no misrepresentations and that neither of us has relied on any pre-contractual statements.
8. User responsibilities
8.1 Users are responsible for their internet security when using the Website and App.
8.2 Users must exercise their own judgment regarding the accuracy of information provided on the Website. TMI cannot guarantee that all of the content on the Website is complete, accurate or up to date.
8.3 Users must contact TMI immediately if they believe their password has been compromised. Users will be responsible for the actions of any interactions conducted in their name until they have notified TMI that they believe their password has been compromised.
8.4 Users must not use the Website with the intention of disinterring mediating TMI in any way. Users must not promote opportunities or services of any company other than TMI on the Website.
8.5 Users must immediately report to TMI of any defamatory, offensive, or illegal material they view on our Website and App.
8.6 Any User who fails and breaches in TMI’s opinion (which need not be reasonable), to comply with these terms and conditions may be immediately barred from using the App and website and any related services. TMI reserves the right to cancel any existing bookings in such circumstances. Even if there is no breach, TMI can still bar users from using the platform/app and cancel a booking.
8.7 Users must ensure to carry a great level of respect and manners when communicating or using the services on the TMI app or website.
9. Responsibilities of students and mothers
9.1 Please note that TMI is not responsible for the conduct of a tuition session, during its delivery by a self-employed tutor. The opinions, actions or personal beliefs of a self-employed tutor are not necessarily shared by TMI. Our self-employed tutors carry individual responsibilities for their words and actions.
9.2 When lessons are held online, the tutor is neither responsible for chaperoning minors, nor guarding a house and household effects while tutoring. Please ensure that a responsible guardian is present throughout a lesson for minors.
9.3 Every student under 16 years of age must be accompanied by one of her/his parents during tuition sessions. Our tutors are instructed not to conduct tuition sessions if no parent is present. Under no circumstance will the tutor or TMI be responsible for the student solely during the tuition session and once the tuition session time is over.
9.4 To conduct their tuition sessions effectively tutors require a quiet room with no distractions or interruptions, including parent/guardian conversation during the period of a lesson as this would affect a student’s concentration and take away time from the session. Any time taken away from the session due to unforeseen distractions will not be made up for by the tutor.
9.5 During tuition sessions, students and adult members of the household should be in modest clothing.
9.6 Students and their parents are to refrain from using inappropriate, disrespectful, or aggressive language/behaviour during, before or after tuition sessions. Aggressive or threatening behaviour will result in immediate termination of the tuition agreement. Any fees paid for future lessons will be forfeited and no refund will be made.
9.7 Students/parents are to maintain good communication with their Tutor and TMI Management team when contacted for advertising, feedback, and lesson-related enquiries.
9.8 Prohibition of Other Arrangements
- Students/parents will not agree on any alternative fees with the Tutor and agree not to render any direct payments to the Tutor.
- Students/parents are not permitted to enter into any private arrangements with any Tutor introduced by TMI. Students/parents undertake to make all bookings with Tutors introduced by TMI exclusively through TMI.
- A breach of these terms will render the students/parents liable to account to TMI for all sums received by the Tutor direct from the Students/parents or from a new Client without deduction and TMI shall be entitled to seek injunctions against the Students/parents to prevent further breaches. These obligations continue beyond the termination or conclusion of this agreement.
- Should you wish to recommend one of TMI’s Tutors to any other Potential or Actual Client, that Client must contact TMI to make a booking through TMI.
10. Attendance and Lateness
10.1 The minimum charge for the attendance of a Tutor at a session is the cost of one hour for the one-to-one model and 1 hour for the group lesson model at the fixed rate for that Tutor. Please note that your Tutor must prepare for each tuition session and the time spent on preparation may be considerable.
10.2 Lessons will start at their scheduled time. If a student is late, the time will not be made up unless the student informs the tutor of an acceptable reason that is an unavoidable circumstance which can be accepted by the Tutor at their absolute discretion. Tutors will allow a maximum of 10 minutes delay to begin the session. Any longer than that tutors will not make up the time for it and will finish the session at the original time booked.
10.3 Where lessons start after their scheduled time due to the tutor’s lateness, the time will be made up within the lesson.
10.4 If a student is late by more than 15 minutes without informing the tutor the one-to-one lesson will be cancelled. The lesson fees will not be refunded, and there will be no make-up lesson scheduled.
11. Cancellations and Missed bookings
11.1 To cancel a scheduled booking, please give the Tutor at least 7 days’ notice in advance. Failure to provide at least 7 days’ notice could result in the time and lesson still being charged and you will not be eligible for a refund. Students must appreciate that the tutor may not be able to book another student in that time slot with less than 7 days’ notice provided. In case of unavoidable emergencies, less than 7-day notice must be escalated to the TMI admin team to review.
11.2 If a cancellation is made by the student with more than 7 days’ notice, Tutors will use their best endeavours to offer you an alternative booking time for one-to-one lessons. An alternative booking time will be offered only subject to availability. The student/parent must appreciate that it may not always be possible to accommodate rescheduling of lessons, in which case the lesson will be missed, and, in that case, the student may still be charged at TMI’s discretion for the session originally booked.
11.3 TMI Tutors (consultants/associates) will be paid for all lessons that are completed and cancelled lessons where no advance 7 days’ notice was issued. However, in the case when a parent/student does provide 7 days’ notice for a lesson, tutors will not be paid for that student’s missed lesson.
11.4 Cancellation with less than 24 hours’ notice due to tutor illness will not be charged, but the opportunity for a session at a mutually convenient alternative time will be arranged as soon as possible. If not, the lesson will not be charged for and the charge will be applied instead to cover the next lesson fees.
11.5 All missed lessons for group class sessions are non-refundable unless we receive 7-day advance notice. In the case of a 7-day notice provided a zoom recording will be sent by the tutor to the student to catch up on their missed lesson content before their next lesson. TMI reserves the right to continue to charge for the lesson as the viability of group lessons depends on all the students attending.
12. Complaints
12.1 A Student may complain about and seek a refund for the service provided by a Tutor, including, but not limited to, a missed lesson or poor quality of teaching (where the student feels that the service provided by a Tutor falls below the standards they reasonably expected and is able to demonstrate this to TMI’s satisfaction). A refund will be issued after review of the complaint after Stripe deducts their platform fee.
12.2 A Student should inform TMI of his or her complaint by either phone or email within 96 hours of the scheduled finish time of the relevant lesson.
12.3 When a Student informs TMI of a complaint within 96 hours of the scheduled finish time of the relevant lesson, TMI will contact the Tutor within 72 hours after such a complaint has been received, by email and text message to inform the Tutor that a Complaint has been raised.
12.4 Should a Student inform TMI of a complaint more than 96 hours after the scheduled finish time of the relevant lesson, Tutors have 48 hours to inform TMI by email or phone of their desire to uphold the complaint (and authorise TMI on the Tutor’s behalf to award the associated refund of the Tutor Fee). Should Tutors not contact TMI within 48 hours to uphold the complaint, TMI, as the agent of the Tutor, will inform the student by email of the Tutor’s decision to reject their Complaint and reject the associated refund request.
12.5 Should the Student and Tutor not reach an amicable agreement regarding the student’s complaint; the Student is entitled to claim the Tutor about the complaint. As set out in clause 10.9, TMI accepts no liability about complaints and the services provided by Tutors.
12.6 Should TMI find that a missed lesson occurred due to any failure of TMI to meet the terms set out in these Terms and Conditions, TMI will refund the student any platform fee paid.
12.7 If a problem arises or you are dissatisfied with the Services, please contact us as soon as possible for the best remedy for your complaint. Email us at [email protected] with your name and contact details and your complaint.
13. Responsibilities of Tutors
13.1 All TMI self-employed tutors need to be Enhanced Check Certified and hold a DBS or Enhanced Certificate to meet the criteria of highly professional and experienced tutors to use the facilities of TMI to generate work for themselves.
13.2 Our self-employed tutors must ensure that their students are given tuition in a congenial and safe environment. Each member has a moral and legal obligation to ensure that, when given responsibility for young people, they are treated with the highest possible standard of care. A child/young person is defined as a person under the age of 18 (The Children’s Act 1989 and 2004).
13.3 All tutors will ensure to dress modestly when attending a tuition booking and will deliver the tuition with great energy, passion, and professionalism.
13.4 All tutors must maintain good communication with TMI when contacted regarding marketing, advertising, booking details, booking fee and their TMI account or database.
13.5 All tutors must maintain professionalism when delivering lessons, communicate with parents/guardians and must be prepared for each lesson and not have distractions during the period of any lessons.
13.6 Tutors are to refrain from using inappropriate, disrespectful, or aggressive language and/or behaviour during, before or after tuition sessions or with the TMI Team. Aggressive, inappropriate, or threatening behaviour will result in immediate termination of the tuition agreement. Any future lessons/students will be forfeited, and no payment will be made. By accepting these Terms and Conditions of all our self-employed tutors, continuation agrees to actively advertise TMI on personal and TMI social platforms. Such as Instagram, Twitter, Facebook, and WhatsApp on a minimum of a monthly basis.
- Our Agreement with our Tutors
14.1 This Agreement is part of these Terms and Conditions and should be read in conjunction with the same.
14.2 Limitations of these Terms and Conditions. These Terms and Conditions are not a contract of employment. Neither You nor the Company is obligated to any specific term of employment. This Agreement is limited to the subject matter of covenants not to compete or solicit as described in this Agreement.
14.3 Covenant Not to Compete. You agree that at no time during the term of your self-employment with TMI will you engage in any business activity which is competitive with TMI.
14.4 For one (1) year immediately following the termination of your associate’s agreement, you will not, for yourself or on behalf of any other person or business enterprise, engage in any business activity which competes with the Company facilities.
14.5 Non-solicitation. During the term of your association, and for three (3) years immediately thereafter, you agree not to solicit any employee, associate or independent contractor of TMI on behalf of any other business enterprise, nor shall you induce any employee or independent contractor associated with TMI the Company to terminate or breach an employment, contractual or other relationship with TMI. Further for a period of three (3) years following the termination of your engagement and your relationship with the Company, you shall not, directly or indirectly, disclose to any person, firm or corporation, the names or addresses of any of the customers, clients, students or parents of TMI or any other information pertaining to them. Neither shall you call on, solicit, take away, or attempt to call on, solicit, or take away any customers, clients, students or parents of TMI on whom you have called or with whom you became acquainted during the term of your engagement, as the direct or indirect result of your engagement with TMI.
14.6 Severable Provisions. The provisions of this Terms and Conditions are severable, and if any one or more provisions may be determined to be illegal or otherwise unenforceable, in whole or in part, the remaining provisions and any partially unenforceable provisions to the extent enforceable shall nevertheless be binding and enforceable. All self-employed consultants (tutors) are responsible for paying all taxes of their own accordingly.
14.7 Electronic Communication. Unless otherwise directed by you, we may correspond using electronic mail. Both you and we agree to use commercially reasonable procedures to check for commonly known viruses before sending information electronically, but each of you and we recognise that such procedures cannot be a guarantee that transmissions will be virus-free. You agree to accept the risks of using electronic mail, including but not limited to the risks of viruses, interception, unauthorised access, delay, misrouting and breakdown of service providers.
14.8 Confidentiality. Any confidential information must only be used in connection with the provision of your services and only be disclosed within your organisation and/or to your professional advisers and if required to do so either by legal or regulatory authorities or otherwise in accordance with any prevailing Non-Disclosure Agreement between you and us.
14.9 Upon termination, we will at your request and your expense return to you any documents supplied by you, provided that we are not required to retain these for legal or regulatory reasons.
14.10 All documents prepared in connection with the provision of your services will become our property and you are not authorised to disclose them to any third party without our prior written approval. You agree and undertake not to disclose to third parties any information relating to or otherwise concerning these Terms and Conditions.
14.11 We each undertake that we will not at any time, disclose to any person any confidential information concerning one another’s business, affairs, customers, clients or suppliers, except as permitted by Clause 2.
14.12 We each may disclose the other’s confidential information: (a) to such of our respective employees, officers, representatives, subcontractors or advisers who need to know such information to carry out our respective obligations under the Contract. We will endeavour to ensure that such employees, officers, representatives, subcontractors or advisers comply with this Clause; and (b) as may be required by law, a court of competent jurisdiction or any governmental or regulatory authority.
14.13 Each of us may only use the other’s confidential information to fulfil our respective obligations under the Contract.
14.14 If however, a Tutor wishes to terminate their contract or withdraw their services if they already have students assigned and are undertaking lessons with these students, then Tutors must provide a 3 month notice period to terminate their services and must continue to deliver their lessons to these students during this notice period. If a Tutor does not have any active students, then the minimum notice period to terminate their services is 1 month.
15. Child Protection
15.1 TMI seeks to provide a safe facility in which children and adults can learn comfortably in the security of their own homes.
15.2 Any User who is the parent of a child under the age of 18 who has a lesson with a Tutor should not leave the child in the sole care of that Tutor.
15.3 All Users must comply with Child Protection policies that are stated in this section, whether or not they are a member of The Tutors’ Association, and all relevant legislation and government guidance. This includes; i. the welfare of the child is paramount; ii. all children, whatever their age, culture, ability, gender, language, racial origin, religious belief and/or sexual identity can receive the benefit of tutoring in a safe environment; iii. all reasonable steps are taken to protect children from harm, discrimination, and demeaning treatment and to respect their rights, wishes and feelings.
15.4 all suspicions and allegations of poor practice or abuse will be taken seriously and responded to swiftly and appropriately; all members who work with children will be recruited about their suitability for that responsibility and will be assisted in being DBS and Enhanced checked and certified.
15.5 They work in partnership with parents and children – which is essential for the protection of children. If any User has a concern regarding child protection, they must contact TMI immediately.

16. Governing Law & Jurisdiction
16.1 These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed by English law and the courts of England shall have exclusive jurisdiction to settle any such dispute or claim will be decided only by the courts of England.
16.2 If any clause or clauses within these Terms and Conditions cannot be enforced, the remainder of the Terms and Conditions shall, to the fullest extent allowed by law, remain in place.
17. Intellectual Property Rights
17.1 All intellectual property rights in or arising out of or in connection with the Services will be owned by us.
17.2 You agree to grant us a fully paid-up, non-exclusive, royalty-free, non-transferable licence to copy and modify any materials provided by you to us for the term of the Contract to provide the Services to you.
17.3 This Clause will survive termination of the Contract.
18. Events outside our control – Force Majeure
18.1 We will not be liable or responsible for any failure to perform or delay in the performance of, any of our obligations under the Contract that is caused by any act or event beyond our reasonable control.
18.2 If an Event Outside Our Control takes place that affects the performance of our obligations under the Contract: we will contact you as soon as reasonably possible to notify you.
18.3 our obligations under the Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. We will arrange a new date for the performance of the Services with you after the Event Outside Our Control is over.
18.4 You may cancel the Contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, we will refund the price you have paid, less the charges reasonably and actually incurred by us in performing the Services up to the date of the occurrence of the Event Outside Our Control.
19. Client Satisfaction Policy
19.1 Client satisfaction of students and mothers is a high priority at Teach Me Islam. We endeavour to ensure the student’s needs are met through our services. TMI provides a feedback option on the TMI platform to allow all students to leave their honest feedback on tutors so we may continue to maintain high standards of services.
19.2 When a client has pre-paid for a course of tuition, and a student is not satisfied with a particular Tutor or if a Tutor must stop tuition mid-course due to unforeseeable circumstances, TMI will endeavour to find a replacement Tutor to complete the full pre-paid lessons.
20. Communication Policy
20.1 When we refer to “in writing” in these Terms, this includes email.
20.2 Any notice or other communication given under or in connection with the Contract must be in writing and sent by email.
20.3 A notice or other communication is deemed to have been received: (a) if sent by email, at 9.00 am the next working day after transmission.
20.4 In proving the service of any notice, it will be sufficient to prove that such email was sent to the specified email address of the addressee.
20.5 The provisions of this clause will not apply to the service of any proceedings or other documents in any legal action. If you have further questions or inquiries, please contact our customer services at [email protected]
